What should I do if I am arrested or indicted in Italy?
Remain calm and ask for an English-speaking criminal lawyer immediately. You have the right to remain silent and to receive legal assistance. Do not sign documents you do not understand. Consular assistance from your embassy is also available.
What are my rights if I am investigated for a crime in Italy?
You have the right to be informed of the specific charges (imputazioni), to remain silent and to have legal representation. You can request a free interpreter if you do not speak Italian, and you have the right to examine all evidence against you.
How does the Italian criminal justice system work for foreigners?
The Italian system provides the same basic rights to foreigners as to citizens. After arrest there is an investigation phase, followed by a preliminary hearing and a trial if necessary. Proceedings are in Italian, but you are entitled to a court-appointed interpreter.
What happens after being formally charged?
You may be called for an interrogation, with your lawyer present. The judge will decide on custody: you could be released pending trial, placed under house arrest (arresti domiciliari), or face detention. Travel restrictions may also apply.
How long does a criminal case usually take in Italy?
It varies significantly. Simple cases take 6 months to 2 years, while complex cases can take 2 to 5 years. Appeals can add further years. Lengthy proceedings do not necessarily mean conviction; many cases result in acquittals or plea deals.
Can I leave Italy while under criminal investigation?
Authorities may restrict your ability to leave Italy (divieto di espatrio) or require you to remain in a specific municipality. Always consult your lawyer before planning travel, as violating restrictions can result in immediate arrest.
What should I do if I am the victim of a crime in Italy?
Report the crime to local police immediately (denuncia). You have the right to be represented by a lawyer and to join the criminal proceedings as a civil party (parte civile) to seek financial compensation for your damages.
Are hearings in Italy held in English or Italian?
All official proceedings are in Italian, but you are legally entitled to a free, certified court interpreter during all hearings. Key legal documents will also be translated. Never agree to proceed without an interpreter if you do not speak Italian.
How can family members contact someone detained in Italy?
Family can contact the police station (questura) or the prison facility. The detained person has the right to notify their family and embassy. A lawyer can schedule confidential visits and coordinate communication with the family abroad.
