Navigating Italian Insurance Claims

Italian insurance companies are notorious for employing aggressive tactics to minimize or outright deny payouts, especially when dealing with foreign drivers unfamiliar with the local legal landscape.

Whether navigating the Direct Compensation Procedure (CARD) or dealing with cross-border policies via the Green Card system, we act as your local shield. We gather the police reports (verbale), coordinate medical experts, and force insurers to pay the maximum compensation you are entitled to.

⚠️

CRITICAL: The Importance of Italian Medical Records

Always seek treatment at an “ospedale pubblico” (Italian public hospital) immediately after the accident, and request ALL documentation in Italian.

Italian insurers routinely challenge and reject foreign medical reports or documentation from private clinics. Public hospital records in Italian create indisputable evidence that insurers cannot contest, while also saving you thousands of euros in certified translation costs. This single step can mean the difference between full compensation and claim denial.

2

Document Everything

Take extensive photos: vehicle positions, damage, license plates, skid marks. Get witness names and phone numbers.

3

Frequently Asked Questions

Crucial information for foreign drivers in Italy

What is the C.A.I. form (Constatazione Amichevole)?
The “Modulo Blu” or C.A.I. is the standard European accident report form used in Italy. If both drivers agree on the dynamics, signing it drastically speeds up the compensation process. However, if you do not understand Italian or disagree with the other driver’s version, DO NOT sign it. Wait for the police.
How long do I have to file a car accident claim in Italy?
You must notify your insurance company within 3 days of the accident. However, for filing a formal lawsuit for damages (Statute of Limitations), under Article 2947 of the Italian Civil Code, you have 2 years from the date of the accident. If the accident involves criminal charges (like vehicular homicide), the limit is extended.
I was hit by an uninsured or hit-and-run driver. Can I still get compensation?
Yes. Italy has a specific state fund called the “Fondo di Garanzia per le Vittime della Strada” (Guarantee Fund for Road Victims). This fund compensates victims of hit-and-run accidents or accidents caused by uninsured vehicles. Filing a claim requires a specific bureaucratic procedure that we handle entirely.
Does my foreign auto insurance cover me in Italy?
If you are from an EU country, your standard liability insurance is valid in Italy. For non-EU countries, coverage depends on the “Green Card” system or specific international agreements. If you rented a car locally, the rental company provides the mandatory RCA (third-party liability) insurance.
Should I accept the first offer from the Italian insurance company?
No, never accept or sign a settlement without consulting an independent lawyer. Initial offers from Italian insurers are almost always intentionally lowballed, especially regarding “biological damages” (personal injury). Signing it usually revokes your right to seek further compensation.
Can I leave Italy before my claim is settled?
Yes. Because personal injury and car accident claims in Italy can take months to resolve, we manage everything remotely for our international clients. Through a Power of Attorney (Procura), we handle the insurance negotiations and court filings while you recover at home.

Don’t Let Insurance Companies Minimize Your Payout

Italian insurers use the language barrier to their advantage. You need an expert English-speaking attorney to fight back and secure what you are truly owed.
